O Superior Tribunal de Justiça (STJ) decidiu confirmar a exclusão dos ex-ministros Anderson Adauto e José Dirceu e dos ex-dirigentes do PT José Genoíno e Delúbio Soares de uma das ações de improbidade administrativa oriunda das investigações do mensalão. A decisão foi tomada pelo tribunal no dia 15 deste mês e divulgada nesta segunda-feira (20/10).
Na decisão, os ministros da Primeira Seção do STJ entenderam que o Ministério Público cometeu um “erro grosseiro” ao protocolar um recurso contra decisão de primeira instância que arquivou o processo de improbidade movido contra os acusados.
O entendimento beneficiou 15 réus, que deixaram de responder às acusações porque já figuravam como partes de outras ações idênticas. O mesmo entendimento foi proferido pelo Tribunal Regional Federal da 1ª Região (TRF1). O tribunal também entendeu que o recurso do MP era inadequado.
De acordo com o acórdão do julgamento do STJ, a decisão que excluiu os quatro acusados do processo deve ser mantida e aplicada a todos os 15 citados, que também já foram beneficiados por decisões anteriores. O tribunal analisou somente questões processuais, e não avaliou as acusações contra os citados.
Prevaleceu no julgamento, o voto do relator, ministro Sergio Kukina.
“As questões subjacentes, envolvendo as condutas ímprobas atribuídas aos réus, como já realçado, não são, por ora, objeto de análise por esta Corte Superior, daí porque, a respeito delas, revelar-se-ia precoce deliberar quanto a eventuais impactos trazidos pela superveniente ordem legislativa”, decidiu o ministro.
