STF JULGA CARLA ZAMBELLI POR PORTE ILEGAL DE ARMA : Leia o voto do Ministro Gilmar Mendes do STF.

O Supremo Tribunal Federal começou a julgar nesta sexta-feira (21) a ação penal contra a deputada federal Carla Zambelli (PL-SP). Ela está sendo acusada de porte ilegal de arma e constrangimento ilegal com emprego de arma de fogo. O caso aconteceu em outubro de 2022. Na véspera do segundo turno das eleições presidenciais, Zambelli discutiu com um apoioador de Lula em uma rua de São Paulo.
A Procuradoria-Geral da República (PGR) organizou uma denúncia contra Zambelli e pediu que a deputada também tenha o porte de arma cancelado e pague uma multa por danos morais de 100 mil reais. Cabe agora aos ministros do STF avaliar se houve crime e qual foi a participação da parlamentar nos delitos. O caso está sendo julgado no plenário virtual do STF, com prazo até a próxima sexta (28), sendo necessário 6 votos para a condenação.
O relator do caso e ministro do Supremo Tribunal Federal (STF) Gilmar Mendes, votou para condenar a deputada a 5 anos e 3 meses de prisão pelos crimes, cassar definitivamente a autorização de porte de arma de fogo da deputada, enviar a arma apreendida ao Comando do Exército, o ministro também foi a favor de declarar a perda do mandato da parlamentar, como consequência da condenação. A ministra Carmem Lúcia e o ministro Alexandre de Moraes, acompanharam Gilmar Mendes.

“A acusada, ao perseguir Luan Araújo com arma em punho, infligiu sobre ele fundado temor por sua integridade física, diminuindo notoriamente sua capacidade de resistência
