Dino (Flávio Dino, ministro do Supremo Tribunal Federal – STF) e Zanin (Cristiano Zanin, também ministro do STF) votaram contra a ação que pedia a retirada de símbolos religiosos, como crucifixos, de prédios públicos. A ação foi movida pela Associação Brasileira de Ateus e Agnósticos (ATEA), alegando que esses símbolos ferem o princípio da laicidade do Estado, previsto na Constituição Federal.
Os ministros argumentaram que a presença desses símbolos não configura violação ao Estado laico, mas reflete aspectos culturais e históricos da sociedade brasileira. Outros ministros, no entanto, podem ter posições diferentes, considerando o caso como um teste para reafirmar os limites da separação entre religião e Estado.
O julgamento é significativo porque trata do equilíbrio entre diversidade religiosa e neutralidade estatal. A decisão final dependerá dos votos dos demais ministros do STF.
Relator do caso no Supremo, Zanin afirmou que os objetos religiosos não ferem a Constitucional e que faz parte do “aspecto-cultural presente”.
“Não fossem apenas os crucifixos, não há como desconsiderar as dezenas de dias consagrados — diversos deles com decretação de feriado —, a nomenclatura de ruas, praças, avenidas e outros logradouros públicos, escolas públicas, estados brasileiros, que revelam a força de uma tradição que, antes de segregar, compõe a rica história brasileira”, escreveu Zanin.
Em suas conclusões, o ministro do STF afirmou que a presença dos símbolos religiosos “não deslegitima a ação do administrador ou a convicção imparcial do julgador,, não constrange o crente a renunciar à sua fé, não retira a sua faculdade de autodeterminação e percepção mítico-simbólica, nem fere a sua liberdade de ter, não ter ou deixar de ter uma religião”.
