Um homem em Goiânia no estado do Pernambuco, registrou um boletim de ocorrência após pagar R$ 210 por 30g de maconha e não receber a droga. No BO, ele argumentou que o STF definiu que até 40g não caracteriza crime e que o traficante agiu de má-fé, enganando usuários recreativos e medicinais. O delegado Humberto Teófilo classificou o caso como inacreditável e instaurou um Termo Circunstanciado de Ocorrência (TCO) contra o denunciante por falsa comunicação de crime.
O homem foi intimado para prestar depoimento e assinar termo no Juizado Especial Criminal. O delegado explicou que não há crime de estelionato nesse caso, pois a maconha é ilícita e não pode ser objeto de transação legal. O artigo 340 do Código Penal prevê pena de seis meses a um ano para falsa comunicação de crime.
O STF decidiu que quem for flagrado com até 40g de maconha deve ser tratado como usuário, não traficante. No entanto, isso não legaliza a droga ou seu comércio, apenas impede que usuários sejam presos ou processados criminalmente.
