O grupo Prerrogativas manifestou-se recentemente solicitando que a decisão do ministro Alexandre de Moraes, que concedeu prisão domiciliar à cabeleireira Débora Rodrigues dos Santos, seja estendida a outras mulheres que se encontram em situações similares no sistema prisional brasileiro.
Débora ganhou notoriedade ao pichar a estátua “A Justiça”, localizada em frente ao Supremo Tribunal Federal (STF), com a frase “Perdeu, mané” durante os atos de 8 de janeiro de 2023. Sua prisão preventiva foi substituída por prisão domiciliar após parecer da Procuradoria-Geral da República (PGR), que levou em consideração o fato de ela ser mãe de dois filhos menores de 12 anos e o encerramento da instrução processual.
Para o grupo Prerrogativas, o benefício concedido a Débora deveria ser garantido a outras mulheres encarceradas que também são mães e não oferecem risco à sociedade. “Isso deveria valer para Chica e para Francisca. Mulheres pobres, pretas, periféricas, não têm no sistema prisional o mesmo benefício”, apontou um dos integrantes do grupo.
A desigualdade na aplicação de medidas judiciais no Brasil tem sido pauta recorrente de organizações de direitos humanos e especialistas em justiça criminal. Dados indicam que mulheres em situação de vulnerabilidade social enfrentam dificuldades para acessar benefícios legais que, teoricamente, deveriam ser aplicados de maneira equitativa.
O debate reacende a necessidade de uma reforma no sistema prisional que garanta um tratamento mais justo e humanizado às mulheres presas, especialmente aquelas que são mães e cumprem pena em condições precárias.
